Mediation is a process in which the parties to a dispute, with the assistance of the Mediator, identify disputed issues, develop options, consider alternatives and endeavour to reach an agreement.
OMCRS adopts a flexible and facilitative style of mediation process. Mediation can be delivered either in person or through the Online Dispute Resolution (ODR) platform. We do not impose a solution nor provide legal advice. Our role in the mediation is to assist the parties:
- To build dialogue, engage in conversation, and listen to each other
- Through consultation and collaboration work out what the disputed issues are
- To identify what issues are important to each party
- Through open and transparent dialogue help the parties to develop options that consider each party’s needs and interests
- To assess and explore options, and consider alternatives, that might lead to an agreed outcome that everyone can live with
- Where agreement has not been reached, we make ourselves available to work with the parties should they wish with other dispute resolution options
